Terms of Use
These terms govern your use of the MovablePay website and its consultation-request and scheduling features.
Effective August 23, 20261. Agreement and Eligibility
By accessing or using this website, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the site. You must be at least 18 years old and have legal authority to submit information on behalf of the business you identify.
2. What the Website Provides
The site provides general information about MovablePay’s business and financial consulting, brand development, online platform, payment, and related services. It also allows visitors to request and schedule an introductory consultation.
Website content and an introductory consultation are informational only. They do not create a merchant-processing agreement, financing agreement, advisory engagement, fiduciary relationship, partnership, or other client relationship unless the parties enter a separate written agreement.
3. Professional Consulting and Direct Services
MovablePay provides professional consulting related to business and financial strategy, payment optimization, brand development, digital platforms, and commerce. For services provided directly by MovablePay, we determine whether to accept the engagement and control its scope, pricing, recommendations, and deliverables, subject to the applicable written agreement.
MovablePay does not provide legal, tax, accounting, securities, or investment advice. Clients should consult appropriately qualified professionals when those specialized matters arise.
Our recommendations are tailored to the information and circumstances provided by each client. While we work to create stronger business outcomes, no particular savings, revenue, growth, or other result can be guaranteed.
4. Processing and Funding Decisions
MovablePay’s underwriting team evaluates applications, identifies appropriate programs, structures submissions, and guides businesses through the payment-processing and funding process.
MovablePay does not make the final approval decision for payment processing or funding. Final approval is determined by the applicable processor, sponsoring bank, funding source, or program partner. Those parties may establish pricing, rates, reserves, limits, repayment terms, equipment availability, settlement requirements, and other conditions under their respective agreements.
5. Consultation Scheduling
Standard consultations are 30-minute phone calls scheduled in Eastern Time. Appointments generally must be booked at least 12 hours in advance and no more than 14 days ahead. MovablePay will call the number provided.
You may request to reschedule or cancel until 12 hours before the appointment by emailing info@movablepay.com. Availability is not guaranteed, and we may need to change or cancel an appointment. We will use reasonable efforts to notify you using the contact information provided.
6. Your Responsibilities
You agree to provide accurate, current information and to use the site only for lawful business purposes. You may not:
- Submit information you do not have permission to provide.
- Submit card, bank, tax, Social Security, credential, or account numbers through the consultation form.
- Interfere with the site, probe its security, introduce malicious code, scrape it through automated means, or attempt unauthorized access.
- Misrepresent your identity or use the site to violate another person’s rights.
7. Intellectual Property
The site, its design, text, graphics, logo, and other original materials are owned by Movable Payment Solutions Inc. or used with permission and are protected by applicable intellectual-property laws. No license is granted except the limited right to access the site for its intended purpose.
8. Third-Party Links and Services
The site may link to or rely on third-party services. We do not control third-party content, terms, availability, or privacy practices. Your use of a third-party service is governed by that provider’s terms.
9. Disclaimers and Limitation of Liability
To the fullest extent permitted by law, the website is provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the site will always be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, Movable Payment Solutions Inc. and its officers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of, or inability to use, the site. Nothing in these terms excludes liability that cannot lawfully be limited or excluded.
10. Governing Law
These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles, except where mandatory law requires otherwise.
